Foreign Buyer Rules in KL and Selangor: What's Actually Changed

If you're a foreigner, an MM2H applicant, or a PR looking at anything in my patch, from Bangsar to Mont Kiara to PJ, there are three numbers you need to know before you fall in love with a unit: the state minimum price, the stamp duty rate that actually applies to you, and whichever MM2H tier you're buying under if that's your route. None of these are new concepts, but two of them changed meaningfully in the last two years, and most of the generic guides floating around haven't caught up.

The price floor: KL vs Selangor

Every state sets its own minimum price a foreigner can buy at, and Kuala Lumpur and Selangor are not the same market here, even though they sit side by side. The minimum threshold for foreigners to acquire a property in Kuala Lumpur is RM1,000,000, and this is a blanket requirement. That covers most projects on this site's Centre of KL and KLCC/Bukit Bintang/TRX pages, but check the district of each KL North/Mont Kiara listing, because some sit just over the line in Selangor.

Selangor is stricter and zone-based. Selangor requires RM2,000,000 for both strata and landed in Zone 1 and Zone 2, covering Petaling, Gombak, Hulu Langat, Sepang, Klang, Kuala Selangor and Kuala Langat, dropping to RM1,000,000 in Zone 3, which covers Hulu Selangor and Sabak Bernam. Petaling district is where PJ and Subang sit, so if you're looking at my KL West / PJ / Subang listings as a foreigner, RM2 million is your real floor, not RM1 million. On top of that, under Pekeliling PTG Selangor Bil. 1/2014, foreigners in Selangor can only buy strata and landed strata, gated and guarded properties, standard individual-title landed is not permitted. These figures come from agent and law-firm summaries rather than the state's own circular, so confirm the current amount with the Selangor land office before you commit.

LocationMinimum price for foreignersProperty type allowed
Kuala LumpurRM1,000,000Strata, most landed
Selangor Zone 1-2 (PJ, Subang, Klang, Shah Alam)RM2,000,000Strata and gated landed strata only
Selangor Zone 3 (Hulu Selangor, Sabak Bernam)RM1,000,000Strata and gated landed strata only

One practical note on my own listings: a project's "from" price is the starting price of the cheapest unit, not what qualifies you. Lunar Seputeh starts from RM610,000 and Residensi 38 Bangsar from RM663,000, both well under the KL threshold. If you're a foreigner, you need the specific unit you sign for to clear RM1,000,000, not the project's entry price. Something like DC Residensi, starting from RM1,140,000, or Imperial Residences at Pavilion Damansara Heights, from RM5,629,000, clears the floor without you needing to hunt for the right stack.

The stamp duty change that actually matters

This is the one that catches people out because it changed recently and a lot of older articles still quote the old number. From 1 January 2026, non-citizens excluding permanent residents pay a flat 8% stamp duty on residential property transfers under Item 32(ab) of the Stamp Act 1949, inserted by the Finance Act 2025, up from the previous flat 4% rate. That's already in force. On a RM1.5 million condo, that's RM120,000 in stamp duty alone, before legal fees and state consent charges.

Two things worth knowing if you're a PR or buying commercial instead. If you're a Malaysian permanent resident, the 8% increase does not apply to you, PRs are excluded from this higher duty and pay the same tiered rates as citizens. And for commercial properties, foreign buyers are currently subject to a lower flat rate of 4%, so if you're weighing a shoplot in my Commercial & Industrial section against a condo, that's a real cost difference to factor in.

MM2H doesn't exempt you from any of this

If you're buying under MM2H, I want to be blunt: the visa does not buy you a discount on either the price floor or the stamp duty. MM2H holders who are not citizens or PRs count as foreign buyers and pay the 8% residential rate.

The programme itself runs on three tiers since the 2024 overhaul, and property purchase is now compulsory, not optional, under every one of them.

TierFixed depositMinimum property purchaseVisa length
SilverUSD 150,000RM 600,0005 years
GoldUSD 500,000RM 1,000,00015 years
PlatinumUSD 1,000,000RM 2,000,00020 years

All MM2H participants must buy and own a residence after approval, and generally cannot sell it for 10 years. If your MM2H property is in Selangor rather than KL, remember the state threshold still applies on top of the tier requirement, so a Silver-tier applicant looking at a RM600,000 unit will not clear Selangor's RM2 million floor or Kuala Lumpur's RM1 million floor, and the budget has to rise to at least RM1 million in KL or RM2 million in Selangor.

One more thing worth flagging if you're on Platinum and thinking about running a business from your MM2H base: MOTAC only permits business activity on the Platinum tier, which made up just 46 of the programme's 3,172 approvals in 2025, and immigration has recently stepped up checks on participants doing business without that specific permission. Worth confirming your tier's actual privileges with your agent before you assume Gold or Silver gives you the same latitude.

None of this is a reason to avoid the market. It just means the budget you quietly worked out six months ago is probably short by the stamp duty alone, and the project price you liked on a listing page may not be the unit that actually qualifies you to buy.
